Your financial data remains yours. We do not claim ownership of your financial information. However, you grant us a limited, non-exclusive license to process your data to provide our services. Our data practices are governed by our Privacy Policy, which is incorporated by reference into these terms. Figena offers multiple service tiers to accommodate different user needs: FREE TIER: Essential financial management capabilities with standard features and community-based support resources. PAID TIER(S): Enhanced functionality, expanded service capabilities, priority support, advanced features, and additional tools as detailed in our current feature specifications. BILLING TERMS: Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change subscription pricing with 30 days' notice to existing subscribers. Payment processing is handled by secure third-party processors. You authorize us to charge your payment method for all applicable fees. Failure to pay may result in service suspension or termination. Specific features and capabilities for each tier are subject to change and are detailed in our current service documentation.
Our current fee structure includes free basic services and paid Professional subscriptions. All fees are clearly displayed before purchase and are charged in advance. Payments are processed securely through third-party payment processors. You are responsible for all taxes related to your use of our services. REFUND POLICY: We generally do not provide refunds for subscription fees, except where required by applicable law or in cases of our service failure. Refund requests must be submitted within 7 days of payment. AUTOMATIC RENEWAL: Professional subscriptions automatically renew unless cancelled before the renewal date. You can manage your subscription through your account settings. PRICE CHANGES: We may modify subscription pricing with at least 30 days' advance notice to existing subscribers.
The Figena platform, including all software, designs, text, graphics, interfaces, and underlying technology, is owned by Figena and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use our services for your personal or business financial management. You may not:

LIMITATION OF LIABILITY: To the maximum extent permitted by law, Figena shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim. These limitations apply regardless of the legal theory and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow these limitations, so they may not apply to you.
You agree to defend, indemnify, and hold harmless Figena, our officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

DISPUTE RESOLUTION: We encourage resolving disputes through direct communication with our support team. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the applicable arbitration association in our jurisdiction. CLASS ACTION WAIVER: To the extent permitted by law, you waive the right to participate in class action lawsuits or class-wide arbitration against us. EXCEPTIONS: Either party may seek injunctive relief in court for intellectual property violations or urgent matters requiring immediate attention. TIME LIMIT: Any claims must be brought within one (1) year after the cause of action arises, or be forever barred.
ENTIRE AGREEMENT: These terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Figena. SEVERABILITY: If any provision is found unenforceable, the remainder of these terms remains in effect. ASSIGNMENT: We may assign these terms or our rights and obligations without notice. You may not assign your rights without our written consent. NO WAIVER: Our failure to enforce any provision does not waive our right to enforce it later. FORCE MAJEURE: We are not liable for delays or failures due to circumstances beyond our reasonable control. SURVIVAL: Provisions regarding liability, indemnification, intellectual property, and dispute resolution survive termination.
